Missed credits expire one tax year at a time

You can claim missed R&D credits by amending a return until that year's statute of limitations closes. There's no program deadline — just each year's window, closing in turn.

Why this matters to your business

From 2022 to 2024, the tax code punished R&D spending

Starting in 2022, businesses could no longer deduct R&D costs in the year they were spent — the deduction had to be stretched over five years or more. The result: higher taxable income and surprise tax bills for companies doing exactly what the R&D incentive was designed to encourage. Many stopped claiming credits altogether. Here's the same business under both sets of rules:

In 2025, Congress permanently restored full same-year expensing of domestic R&D. And the credits you missed in 2022–2024 can still be claimed on amended returns — for every tax year whose window remains open. That recovery is what this session is about.
